1. Who we are

Swavio is a food ordering and delivery service operated by Bessefo Technologies Private Limited (“Swavio”, “we”, “us”, “our”), a company incorporated in India.

We are the data fiduciary for the personal data described in this policy. This policy explains what we collect, why, who we share it with, and the rights you have over it.

2. Information we collect

Information you give us

  • Contact details: your name, WhatsApp or mobile number, and email address if you provide one.
  • Waitlist details: if you join our pre-launch waitlist, we record the details you submit and when you submitted them.
  • Delivery details: the delivery address, landmark and any instructions you give us for an order.
  • Order details: the items you order, quantities, order value, order history and any preferences or dietary notes you share with us.
  • Communications: messages, questions, feedback and complaints you send us, on WhatsApp or by email.

Payment information

Payments are processed by regulated third-party payment providers. We receive confirmation of whether a payment succeeded or failed, the amount, and a transaction reference. We do not collect or store your full card number, CVV, UPI PIN or banking credentials. Those are handled directly by the payment provider under their own terms and security standards.

Location information

We use your delivery address to determine whether you are inside a serviceable area, to calculate delivery, and to route your order. If you choose to share your device location to fill in an address, we use it only for that purpose. We do not track your location in the background.

Information collected automatically

When you visit our website we may collect technical information such as your IP address, browser and device type, pages viewed and the time of your visit. This is used to keep the service secure and to understand how it is used.

3. Data collected through WhatsApp

We communicate with customers using the WhatsApp Business Platform, provided by WhatsApp LLC and Meta Platforms, Inc. (“Meta”). When you interact with us on WhatsApp:

  • We receive your WhatsApp phone number and WhatsApp profile name.
  • We receive the content of the messages you send us, including catalogue and cart messages, order messages and any text, images or location you send.
  • We send you messages relating to your order and, where you have opted in, messages about our launch, offers and updates.
  • Meta processes these messages in order to deliver them. Their handling of your data is governed by the WhatsApp Privacy Policy, which is separate from this one.

We only send you WhatsApp messages where you have given us your number and consented to being contacted, or where you have messaged us first. You can ask us to stop at any time by replying STOP or by emailing us.

4. How we use your information

  • To take, prepare, deliver and support your orders.
  • To process payments, refunds and cancellations.
  • To send you order updates and delivery notifications on WhatsApp.
  • To respond to your questions, feedback and complaints.
  • To tell you when we launch, and to send offers and updates where you have consented to receive them.
  • To improve our menu, pricing, delivery operations and service quality.
  • To detect, prevent and investigate fraud, abuse and security incidents.
  • To meet our legal, tax and regulatory obligations.

We rely on your consent, on the necessity of processing to perform our contract with you, and on our legal obligations, as the bases for this processing.

5. Who we share your information with

We do not sell your personal data. We share it only as set out below:

  • Delivery personnel and partners: your name, delivery address and contact number, so your order can reach you.
  • Payment providers: to process your payment and any refund.
  • Meta / WhatsApp: to deliver messages to and from you on WhatsApp.
  • Technology providers: hosting, database, analytics and communication providers who process data on our behalf under contract. Our website is hosted on Vercel and our data is stored using Supabase.
  • Professional advisers: accountants and lawyers, where needed.
  • Authorities: where we are required to disclose information by law, court order or a lawful request.

Some of these providers may store or process data outside India. Where that happens, we take steps to ensure your data remains protected in line with applicable law.

6. How long we keep it

  • Waitlist details: until you ask us to delete them, or until they are no longer needed for the launch they were collected for.
  • Order and transaction records: for as long as required under Indian tax and accounting law, typically up to eight years.
  • WhatsApp conversations: for as long as needed to support you and resolve disputes.

When data is no longer needed, we delete it or anonymise it so it can no longer identify you.

7. Security

We take reasonable technical and organisational measures to protect your personal data, including encrypted connections, restricted access to our systems, and access controls on our database. No system is completely secure, and we cannot guarantee absolute security, but we work to protect your data and will notify you and the relevant authority of a breach where the law requires it.

8. Your rights

Under India’s Digital Personal Data Protection Act, 2023 and other applicable law, you have the right to:

  • Access the personal data we hold about you.
  • Have inaccurate or incomplete data corrected or updated.
  • Request erasure of your data. See our Data Deletion page.
  • Withdraw consent at any time, including consent to receive WhatsApp messages.
  • Nominate another person to exercise these rights on your behalf.
  • Raise a grievance with us, and escalate it if unresolved.

To exercise any of these rights, email saurabh@swavio.in. We may need to verify your identity before we act on a request. We respond within the timeframes required by law, and in any case as promptly as we reasonably can.

9. Children

Swavio is not intended for children. We do not knowingly collect personal data from anyone under 18. If you believe a child has given us their data, contact us and we will delete it.

10. Cookies

Our website uses only the cookies and similar technologies needed to operate the site and understand basic usage. You can control cookies through your browser settings.

11. Changes to this policy

We may update this policy as our service changes. When we do, we will update the “last updated” date above. If the change is significant, we will tell you directly where we reasonably can.
